In India, customs agents (CHA) are licensed to act as agents for any business transactions related to carrier or import or export entries or departure goods at customs. CHA maintains detailed, up-to-date and up-to-date accounts. The CHA license may be temporary or permanent.

Qualification
An applicant must:
- Be a recognized university graduate.
- Hold pass in 'G' Form as company or company employee.
- Should have three years experience in customs work.
- It should have assets certified by the bank of Rs.5 lakh.
- If there are more applicants than licenses, the Commissioner chooses on the basis of seniority holding the G pass. If two people have the same seniority, the older person will be preferred.
An applicant must have a pass in Form G for only one year with written authorization from the Commissioner.
Clarification
- The diploma in Customs clearance and delivery of goods offered by the University of Mumbai is not considered a "graduation" for eligibility purposes.
- The employee, partner or director of the CHA license holder authorized for inspection under Rule 9 (5) may take three examinations within two years from the date of application by the licensee for review.
- The level of knowledge of the local language must be determined by the Commissioner; Rules have no requirements. Knowledge of local languages ââby official representatives is considered sufficient. Proficiency in Hindi is desirable.
- A person passing an exam under Rule 9 (5) may apply for a CHA license when the application is requested, subject to other qualifications.
- The person who grants the CHA license prior to the 1997 change requiring graduation will continue to be eligible for renewal.
Multimodal transport operators as CHA
Multimodal transport operators (MTOs) are designated under the Multimodal Goods Transportation Act, 1993 by the Ministry of Transport of Surface. Their work involves carrying goods with more than one mode of transportation between India and abroad. It does not entitle them to get an appointment as a steamboat or CHA agent unless they are otherwise eligible for appointment.
License type
Temporary
Upon receipt of the application, a one-year temporary license is granted under Rule 8 in Form B. Before receiving a temporary (or regular) license, the applicant must execute the bonds on Form D and E. For the main port, the total number of guarantors is Rs.25000/; for another port, Rs.10000/. Warranties may also be granted in the form of a National Savings Certificate or postal security, which must be pledged as Commissioners. Since regular licensees are allowed to work in more than one Customs office, separate bonds and guarantees must be posted for each customs.
Regular
Applications for a regular license can be made on Form C by someone who has passed the exam. Forms A and C are almost identical, except that while the first is issued under Rule 5, the last form is issued under Rule 10. Regular licenses are requested on Form D. Applicants must meet the following requirements:
- Number or norm of cargo value cleared from customs house (as determined by the Commissioner)
- Applicant behavior during the temporary license period; no complaints mismatch with Regulation 14
Regular licenses are non-transferable, and the term is ten years.
Disqualification
Rule 10 (1) provides that only qualified persons in the examination may apply for a regular license. Sub-regulation 3 stipulates that the Commissioner may reject the application of a person failing the exam. If performance criteria are dissatisfied with regard to quantity and value of concessions or behavior, the application may be rejected. An appeal may be made on a 30-day rejection order to the President Commissioner, who is also empowered to review a regular license grant within one year.16915032
The Customs House agent acts on your behalf with customs officials to undergo the necessary procedures and formalities for import and export licenses. In exports, customs brokers send documents to exporters after completing the required export formalities with customs. In import trade, the goods are sent to the importer by the customs broker after completing the necessary customs import procedures and formalities with the customs department.

Accounts must reflect all financial transactions entered as CHA. Copies of all submitted documents (such as shipping charges, invoices and transshipment applications) must be maintained for at least five years and should be available for inspection by departmental personnel.
Task

- Private permission '' '' : CHA must personally delete the item or delete it through an employee designated by the Commissioner. All documents must include the CHA name at the top. CHA should not try to influence the behavior of customs officers in matters pending before him or his subordinates; there shall be no threat, false accusations or coercion against such officers, and no promises of profits, benefits or gifts shall be made or provided to such officers. CHA's duties must be dismissed immediately, and he can not charge more than the rates approved by the Commissioner.
- Conflict of interest : If CHA is a former department official, she can not represent any issues before the customs officer whom she considers an officer. He can not use facts that come to his knowledge as an officer.
- Correct advice : CHA should advise clients to comply with the provisions of the Act and regulations, diligently ensuring the provision of correct and relevant information to clients for cargo or baggage release. If there is non-compliance by the client, the CHA must bring it to the attention of the deputy or assistant commissioner. This regulation requires the CHA to provide information to the department.
- Fiscal accountability : The CHA should immediately pay the government all the money received from clients for duties and taxes. Any money received from clients or from the government should be promptly and fully accountable to the client.
Recording: A CHA should not attempt to collect information from government records if not provided by the appropriate officer. Access to records should not be denied, deleted or hidden when searched by the Commissioner. Records and accounts should be maintained as directed by the Deputy or Assistant Commissioners, and available for review. All documents must be prepared in accordance with the rules and orders.
If the license granted to the CHA is lost, the loss must be immediately reported to the Commissioner. If there is a failure to fulfill the obligations under Rule 14, the Commissioner may prohibit a person from acting as a CHA.
Handling changes
Any change in the partner or director should be referred to the Commissioner. If there is a change in the constitution of the company or company, the application for a temporary and regular license must be done within 30 days of the change. If there are no adverse findings against the company or company, the Commissioner will grant a license in the previous category held by the company or company. Meanwhile, the company may continue as a CHA by applying to the Commissioner.
If the CHA is not a company or company, the Commissioner will grant permission to continue as a CHA if there is any change in the constitution of concern. If this change is caused by the death of a licensed CHA, his legitimate heir (assisting him in his work as a CHA under Rule 20) may be granted a license that has no harmful findings and the proceedings of the examination. Changes of a qualified person acting on behalf of the firm or company shall be immediately given to the Deputy or Assistant Commissioners.
